1. Who has the statutory right
A consumer who concludes a distance service contract generally has 14 calendar days from conclusion to withdraw without giving a reason. This can apply even when a contract is agreed through Telegram or email. A business purpose is assessed from the actual transaction, not just a label in a template.
The withdrawal information must be supplied before acceptance. Failure to give it can extend the withdrawal period as prescribed by law. Contractual cancellation or rescheduling is separate from this statutory right.
2. Starting within 14 days
To start a paid service during the withdrawal period, obtain the consumer’s express request in a retainable form. The consumer must be informed of proportional payment for service already provided in the circumstances permitted by law.
The right is lost after the service is fully performed only where the legal conditions are met, including prior express consent to start and acknowledgement of that consequence. A date reservation, personalised advice or an ordinary acceptance of terms does not automatically remove the right.
3. How to withdraw and refunds
Send an unequivocal statement to the provider’s email or business address below before the deadline. The model below may be used but is not compulsory. Keep proof of sending. The provider confirms receipt in a retainable format.
Refunds required by withdrawal are made within 14 days of notification, using the same payment method unless another method is expressly agreed without cost. Only lawful proportional charges for properly requested early performance may apply. There is no automatic cancellation penalty.

5. Online contracting and events
If online contracting is introduced, withdrawal controls must be assessed against the rules then applicable, including the EU online withdrawal-function requirements and their Spanish implementation. This template does not claim that a manual form satisfies such a function.
Certain dated leisure services have specific statutory exceptions. Event organisation or speaker production is not automatically exempt merely because a date is booked. The actual contract and consumer status must be assessed.
